RED LODGE, Mont. - A 27-year-old woman convicted of tampering with evidence in a 2004 shooting death pleaded not guilty Tuesday to deliberate homicide.

Bianca Wilson, of Billings, appeared before District Judge Blair Jones for the death of 30-year-old Justin Marchant, of Cowley, Wyo. Marchant's body was found in September 2004 on a rural road in Carbon County just north of the Wyoming border.

Prosecutors say Wilson shot Marchant while the two were in a car being driven by Jesus Villarreal, of Billings. She is accused of shooting the man because she suspected he was an informant.

Wilson was arrested three days after Marchant's body was found and was charged with deliberate homicide and aggravated kidnapping for allegedly forcing Villarreal at gunpoint to drive to Billings after the shooting.

Prosecutors eventually dismissed the charges because of lack of evidence, but they reserved the option to refile the murder charge.

Wilson and Villarreal were instead charged with evidence tampering for allegedly trying to hide the car and clean Marchant's blood from the interior.

Wilson was convicted on that charge in February 2006 and is serving a five-year prison term. A judge declared a mistrial for Villarreal in March 2007 after finding that two witnesses gave prejudicial testimony against him by linking him directly to Marchant's murder.

Assistant Attorneys General Barbara Harris and Kathy Seeley refiled the original murder charge against Wilson on May 29. Her bail was set at $50,000 Tuesday.
