Two men charged in connection with a May boating crash on Alcova Reservoir appeared in court on Wednesday for the first time since their arrest

The men indicated they were still receiving medical treatment from injuries sustained when the boat they were traveling in crashed into a Fremont Canyon wall on May 16. Two other people in the boat suffered serious injuries and one remains hospitalized.

The boat's owner, Seth Linaman, listened quietly as Natrona County Circuit Judge Michael Huber went over the charges against him. Linaman, who wore his right arm in a sling, faces two charges of aggravated assault and a single count of boating under the influence.

Charles Denney, who was allegedly driving the boat close to the time of the crash, is charged with boating under the influence and cocaine possession. According to investigators, Denney claimed Linaman grabbed the steering wheel and pushed the throttle to full just before the crash.

Both men were arrested Tuesday afternoon following an investigation by the Natrona County Sheriff's Office and Wyoming Game and Fish.

Tests taken after the crash indicated the men had blood alcohol concentrations above the legal limit for Wyoming. Linaman's came back at .11 while Denney's was .09, according to authorities.

An investigator's affidavit had originally listed Denny's blood alcohol concentration at .29, but prosecutors Wednesday said that number had been incorrect.

Huber set Linaman's bond at $25,000. Prosecutors asked for four times that amount, but Linaman's defense attorney argued his client has ties to this community and wouldn't flee if he made bail.

Linaman, a 31-year-old Army veteran who served in the Iraq War, is still receiving medical treatment and is taking a number of medications, his attorney, Richard Jamieson, told the court.

"I don't think he is a flight risk, and I don't think he is a danger to the community," Jamieson said.

Denney's bond was set at $10,000. Appearing without an attorney, he told Huber he only recently left the hospital and had medical tests scheduled for next week.

"I can't walk really," he said.

Witnesses say the boat, a 30-foot 1979 Excalibur speed boat, crashed into the canyon wall after going airborne after hitting another boat's wake. When it landed, the boat apparently made an immediate right turn and hit the canyon.

Passenger Allen Sosa, 22, suffered a severe cut in the crash that ran from his leg to his stomach. He required surgery and is still hospitalized. Another passenger, 27-year-old Jamie Steward, fractured her femur and broke bones in her face. She spent four days in the hospital and underwent multiple surgeries.

Steward told investigators Linaman's handling of the boat scared her. She apparently asked to be dropped off before the crash, but the others convinced her to stay.

Linaman and Denney are due back in court within a month for a preliminary hearing.
