Sentences

*Anderson Darwin Antelope, 22, of Ethete was sentenced by Chief Federal District Court Judge William F. Downes on Dec. 27, 2005 for use of a firearm during a crime of violence and aiding and abetting. Antelope received five years of imprisonment, a $1,000 fine, and five years of supervised release. This case was investigated by the Bureau of Indian Affairs and the Federal Bureau of Investigation.

*Buillermo Augustin Cerros-Godoy, 40, of Honduras was sentenced by Chief Federal District Court Judge William F. Downes on Jan. 9, 2006 for illegal re-entry of a deported alien into the United States. Cerros-Godoy received 10 months and one year of supervised release. This case was investigated by the Bureau of Immigration and Customs Enforcement.

*Pepe Cota-Villa, 30, of Chihuahua, Mexico was sentenced by Federal District Court Judge Clarence Brimmer on Jan. 6, 2006 for being an illegal alien in possession of a firearm. Cota-Villa received one year, four months of imprisonment and three years of supervised release. This case was investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives.

*Yolanda Cruz-Aceves, 40, of Parlier, Calif., was sentenced by Federal District Court Judge Clarence Brimmer on Jan. 6, 2006 for possession with intent to distribute approximately 26 pounds of cocaine and approximately seven pounds of heroin. Cruz-Aceves received five years, 10 months of imprisonment, a $250 fine, and three years of supervised release. This case was investigated by the Wyoming Highway Patrol, Wyoming Division of Criminal Investigation and the Drug Enforcement Administration.

*David Bryan Forbes, 50, of Casper was sentenced by Federal District Court Judge Alan B. Johnson on Jan. 9, 2006 for money order kiting and issuance of money orders without payment. Forbes was ordered to pay a fine in the amount of $750. This case was investigated by the United States Postal Inspection Service.

*Robby Allen Hansen, 23, of Cody was sentenced by Federal District Court Judge Clarence A. Brimmer on Jan. 9, 2006 for destruction of mail. Hansen received one year of probation. This case was investigated by the United States Postal Inspection Service.

*John Hanway, 20, of Lander was sentenced by Chief Federal District Court Judge William F. Downes on Jan. 9, 2006 for using a firearm during a crime of violence and aiding and abetting. Hanway received five years of imprisonment, a $1,000 fine, and five years of supervised release. This case was investigated by the Bureau of Indian Affairs and the Federal Bureau of Investigation.

*Juan Alonso Hijine-Rios, 37, of Mexico was sentenced by Federal District Court Judge Alan B. Johnson on Jan. 9, 2006, for illegal re-entry of a previously deported alien into the United States. Hijine-Rios received three years, five months of imprisonment and two years of supervised release. This case was investigated by the Bureau of Immigration and Customs Enforcement.

*Charles Edward Michael Kolacz, 35, of Lakewood, Colo., was sentenced by Chief Federal District Court Judge William F. Downes on Jan. 9, 2006 for possession of firearms not registered in the National Firearms Registration and Transfer Record and possession of machine guns. Kolacz received one year, three months of imprisonment and three years of supervised release. This case was investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives.

*Joshua Misiak, 24, of Mason, Mich., was sentenced by Federal District Court Judge Alan B. Johnson on Jan. 9, 2006 for conspiracy to possess with intent to distribute approximately two pounds of cocaine, being a felon in possession of a firearm and carrying a firearm during and in relation to a drug trafficking offense. Misiak received 10 years of imprisonment, a $500 fine, and five years of supervised release. This case was investigated by the Wyoming Division of Criminal Investigation.

*Ignacio Lara-Ibanez, 29, of Jalisco, Mexico was sentenced by Federal District Court Judge Clarence A. Brimmer on Jan. 9, 2006 for illegal re-entry of a previously deported alien into the United States. Lara-Ibanez received three years, 10 months of imprisonment, a $250 fine, and three years of supervised release. This case was investigated by the Bureau of Immigration and Customs Enforcement.

*Robert Dale Martin, 24, of Laramie was sentenced by Federal District Court Judge Alan B. Johnson on Jan. 6, 2006 for being a felon in possession of a firearm. Martin received two years, three months of imprisonment and three years of supervised release. Martin was also court ordered to remain current in his child support payments. This case was investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives.

*Denise M. McGonigal, 37, of Billings, Mont., was sentenced by Federal Magistrate Court Judge William C. Beaman on Jan. 9, 2006 for failure to pay child support. McGonigal was ordered to pay $12,320 in restitution. This case was investigated by the Wyoming Department of Family Services and the Department of Health and Human Services.

*Shaelen Morgan, 32, of Victoria, British Columbia was sentenced by Federal District Court Judge Alan B. Johnson on Jan. 9, 2006, for possession with intent to distribute approximately 250 pounds of marijuana. Morgan received three years, one month of imprisonment, a $13,263 fine, and four years of supervised release. This case was investigated by the Wyoming Division of Criminal Investigation.

*Gayle Morean Nelson, 34, of Laramie was sentenced by Federal District Court Judge Clarence A. Brimmer on Jan. 9, 2006 for unlawful use of a means of identification and aiding and abetting. Nelson was ordered to pay $1,500 in restitution and received three years of supervised release. This case was investigated by the United States Postal Inspection Service.

*Armando Olivares, 30, of Delicias, Chihuahua, Mexico was sentenced by Federal District Court Judge Clarence A. Brimmer on Jan. 11, 2006, for conspiracy to possess with intent to distribute and to distribute approximately 1/3 of a pound of methamphetamine. Olivares received five years of imprisonment and four years of supervised release. This case was investigated by the Laramie County Drug Task Force, Cheyenne Police Department and the Drug Enforcement Administration.

*Stanley Grange, 55, of Cheyenne was sentenced by Federal District Court Judge Alan B. Johnson on Jan. 12, 2006, for conspiracy to possess with intent to distribute and to distribute approximately three pounds of methamphetamine. Grange received five years, 10 months of imprisonment and five years of supervised release. This case was investigated by the Larimer County Drug Task Force and the Wyoming Division of Criminal Investigation.

*Duane Spitale, 44, of Loveland, Colo., was sentenced by Federal District Court Judge Alan B. Johnson on Jan. 12, 2006 for possession with intent to distribute and to distribute approximately three pounds of methamphetamine. Spitale received 16 years, six months of imprisonment, a $1,000 fine, and five years of supervised release. This case was investigated by the Larimer County Drug Task Force and the Wyoming Division of Criminal Investigation.

Spitale manufactured methamphetamine using the hypophosphorous production method. His clandestine methamphetamine laboratory was located at his home in Loveland, Colo. Spitale supplied Stanley Grange of Cheyenne, Wyoming with methamphetamine produced from his lab. Grange distributed the methamphetamine in Cheyenne and Wheatland. Spitale's sentence was enhanced for creating a substantial risk of harm to the life of a minor. Spitale manufactured methamphetamine during a three-year period while two minor children lived in the home.
