GILLETTE (AP) - Thursday's winter storm forced a delay in the hearing over whether a Gillette man should receive the death penalty for ordering the death of a 16-year-old boy in 2005.
Kent Alan Proffit Sr. on Wednesday argued that he shouldn't be put to death. A jury on Monday found him guilty of directing two other men to kill Bryce Chavers, 16, in 2005.
Unless the jury unanimously agrees to impose the death penalty, Proffit will receive a life prison sentence.
Proffit, 43, is already serving a life prison sentence without parole for a conviction in the separate October 2005 murder of 19-year-old Jeremy Forquer.
District Judge Dan R. Price answered the telephone at the courthouse on Thursday and said there would be no proceedings in Proffit's death penalty hearing until Friday because of the storm. District Judge John Perry is presiding over Proffit's case.
Price said he understands that the jury today will hear final jury instructions from Perry and then hear final arguments from both the prosecution and defense lawyers. The jury will then begin its deliberations on whether Proffit should get the death penalty.
Chavers had been scheduled to testify against Proffit in a sexual assault trial when was shot to death while in his bed at his home in Gillette. Two other men either have been convicted of or pleaded guilty to killing Chavers.
