Police arrested a Casper man on Saturday night and alleged he pulled a gun during an altercation at a local motel.

Benjamin J. Macias Sr., 59, was at the Royal Inn on Saturday night when he and another man began arguing, according to police documents summarizing witness statements.

The argument escalated before Macias pulled out a .38 Special, witnesses told police.

A witnesses said Macias had pulled a gun but not pointed it at the other man. The other man involved in the argument said Macias had pointed the gun at him, according to the documents.

The documents state another witness said Macias and the other man stood “toe to toe.” Macias then pulled the gun and said “I’ll shoot your ass but I would rather whoop your ass instead,” the witness told police. Macias put the gun away but the witness did not see either man throw a punch.

When Macias spoke to police, he denied pointing the gun at the other man. He said the other man threatened him and then threw a punch.

Police found the unloaded revolver in Macias’s pocket.

Macias remained in custody Monday morning.
